Do "Shelter in Place" Orders Qualify as "Quarantine or Isolation Orders"

Many businesses are currently subject to state or local orders urging local residents to "stay home" except for certain limited purposes and requiring non-essential businesses to close.

Forms

Employers will need forms to have employees complete and submit for the paid FMLA leave. The forms should help facilitate the leave and reduce questions. It should have employees certify the leave and explain they must return when the circumstances are removed. Forms/ Documents required & Taxes and Deductions

They need to provide clarification/ guidance on the forms and documentation that will be required for taken leave. Are we supposed to take the employee's word for it? Since there is a different rate of pay depending on the reason for leave then I would think we would need to document the reason. Shelter in Place Order - Not a Quarantine or Isolation Order

I believe that DOL should make it clear that a quarantine or isolation order issued by a federal, state or local government is not the same as a shelter-in-place order. Employees under a government issued "stay at home" order

Do employees in a county/state where the government has issued an order for everyone to stay at home unless you are in an essential business qualify for the Emergency sick pay under the FFCRA qualifier:

"is subject to a Federal, State, or local quarantine or isolation order related to COVID-19." Or do they personally have to have been ordered to be isolated or quarantined?

Apr 2 deadline

Clarification on the Apr 2nd deadline. Does leave not count before Apr 2? What if an employee got sick yesterday? They only get paid for sick days after Apr 2nd or did the time frame start after legislation was passed? If we cover someone by the sick leave before the Apr 2nd deadline will it be eligible for reimbursement?

Providing Proof / Gathering Proof re: Employees

Lot of stress!!! 😬
At some point, if proof is required to show how an employee took sick leave or FMLA during the pandemic, these could be:
- approved timesheets showing paid sick leave
- news article of a school / daycare closing (causing an employee to stay home w/ children) noting start and end dates?

Clarifying - does a state's closure of businesses considered quarantine/isolation and trigger paid leave?

Is a state's closure of businesses considered a quarantine or isolation requirement that would trigger the new emergency sick leave requirements? So will every employer who is shut down and does not furlough staff be required to pay 10 days of sick leave?

Create an Integrated Online Portal > "ACCESSING RELIEF FOR COVID-19 DUMMIES"
