Will FMLA leave previously taken within the past year count against taking expanded leave?

I am the Founder and Executive Director of the Gender Equality Law Center based in NYC. Time off

My employer MUYhamburgers (Wendy's franchise) sent out a memo basically saying if you have COVID 19 they will ASSIST if PTO is needed . This is not right I SHOULD NOT HAVE TO USE UP MY PTO TIME FIRST then get assistance. They think that if you get it you will only need 2 weeks off to recover . Wage Protection

Employee basic/standard wages and pay should be protected and continued in the event a pandemic of such shall occur again. This will assist with Americans to be able to continue paying bills as necessary. Reduce Production, automate industry doors & washrooms

Every industry is equally important. All sectors must be productive to maintain the economy & Health.

If production in all sectors (except preventive care like surgical) is halfed for 2months, there is possibility of creating safe work environment.

Half the workforce will work for one day and half will work on the other.
Due to reduced workforce, chances of transmitting the diseases will reduce.

Part Telework?

Our office is set up to where we can work remotely which I am currently doing since school is shut down until Mid April- (as of now). I am working remotely while watching my two kids since I do not have available childcare. However, this schedule is not sustainable as my children need someone to keep their minds active and ensure they get physical exercise and not just watch TV all day. Paid Sick Leave / FMLA for Employees who can Telework

The state in which a majority of our workers are from, has shut down schools and child care centers for the next few weeks (and this began a couple of weeks previous). No Layoffs

Unfortunately, a lot of individuals in the younger age group (19 - 35) are NOT being tested, even when requesting medical attention. If they have not traveled outside the country, or fall into the older age group, they are being told they will not be tested. Step by Step instruction with examples

As this is new territory for all, it would be nice to have specific examples for employers on how to handle each situation that needs to be covered. While every situation is circumstantial, it would be nice to have a guide for all 6 items and how it should be handled and what that employee should be paid.

Repeal the Act now

This Act has the unintended consequence of causing mass layoffs so that employers do not get burdened with paid sick leave on top of what they already provide. We are putting millions of out of work and burdening our unemployment system and leaving workers without pay to pay their bills. This Act is not good for businesses or workers. Paid Leave

During a pandemic such as Covid-19, where parents/caretakers/guardians cannot find or do not have care due to schools/daycares, and adult daycares being shut down, they should be able to get paid by their employer or be able to seek unemployment. Also, they should not receive any retaliation from their place of employment.
