Guidance should be issued specifying that pandemic related leaves/furloughs should be treated like FMLA leaves and other special leave and not count against ACA tracking of FT status and affordability. Even better, there would be some temporary relief for ACA reporting for employers and mandates for 2020 due to Covid19-- like a special safe harbor recognizing that this year is an outlier in terms of hours worked/wages earned. There should still be protections in place for employees to retain coverage and maybe specific grants/subsidies/tax credits for health insurance premiums. People need their health insurance during a pandemic and their FT status shouldn't be jeopardized when employees and employers are doing the right thing for the overall health and safety of all following shelter in place orders and social distancing guidelines.
