Allow Employers of Health Care Providers to Opt Out to Ensure Vital Services Continue

H.R. 6201 SEC 5111 authorizes the Secretary of Labor to issue regulations to exclude certain health care providers and emergency responders from the definition of employee under section 5110(1) including by allowing the employer of such health care providers and emergency responders to opt out of the provisions related to Emergency Paid Sick Leave Act.


As providers of vital community-based services for people with mental illness, substance use disorders, and intellectual and development disabilities, Community Mental Health and IDD Centers in Texas employ a wide range of discrete health care and health-related providers, as well as the administrative and support staff who make it possible for them to deliver services.


These Community Centers, and other community-based health care organizations throughout the country, will be put at operational risk if the regulations do not provide a clear way for the employer of heath care providers to opt out of the provisions.
